Does the code differ whether a card is discarded by discard button or by card effect ?
( Was about to create a new card concept, that punishes discarding cards by card effect but I don't want it to punish regular discards )

Indeed. It really does matter whether you discard a card by standard discard action or by card effect. When you specify new card you must think of this as two separate thigns. See more information in Game manual -> Card template
